GİRİŞ

STARTER PACK, Next4biz CRM/CSM/BPM için hazırlanmış bir ürün paketidir. Bu ürünlerden birine ilişkin Starter Pack paketini satın almanız halinde uymanız gereken kurallar işbu kullanım şartlarında belirlenmiştir.

Ürün paketini kullanırken bildireceğiniz verilerinizin yönetilmesi ve işlenmesi ile ilgili taahhüdümüz niteliğindeki kişisel verilerin işlenmesine dair Aydınlatma Metnine, KVKK Taahhüdümüze ve Gizlilik Politikamıza bu linklerden erişebilirsiniz.

KULLANIM KOŞULLARI

1. Starter Pack ürün paketine ilişkin satın alma siparişi vermeniz ve paket ücretini ödemeniz halinde Starter Pack’e dahil olan ürün ve hizmetlerimizi kullanıcı adınız ve şifreniz ile kullanmaya başlayabilirsiniz.

2. Starter Pack ürün paketi sadece kullanıcı kaydı oluşturulan kişi(ler) tarafından ve lisans sayısı ile sınırlı olarak kullanılabilir. Bu kişi(ler) dışında kullanıcı adı ve/veya şifrenizi 3.kişilere kullandırılamaz. Kurum ve şirket müşterilerimizin kullanıcıları adına açılan her bir kayıt için tanımlanacak münferit kullanıcı ismi ve şifreleri (“Login”) ile bizzat o kişiler tarafından giriş yapılmalıdır. Her Kurum/şirket kullanıcı olarak belirlediği gerçek kişi kullanıcıların kayıtlarını doğru ve eksiksiz şekilde tutmak sorumluluğunu kendisi taşır. Bir kullanıcı hesabının sadece adına kullanıcı kaydı oluşturulmuş olan kişi tarafından kullanılmasına izin verilmektedir. Her kullanıcı gerçek kişi login bilgisinin gizliliğinden sorumlu olup bu login ile başka kişilerin giriş yapmamasını sağlamakla yükümlüdür. Ürün ve hizmetlerin robot, otomatik işlemciler, yapay zeka gibi gerçek kişiler dışındaki araçlarla kullanılması ek lisanslar gerektirir.

3. Starter Pack ürün lisans ücreti: ürün sipariş ve onay süreçlerinde belirtilen 6(Altı) aylık lisans bedeli ile hizmet bedeli peşin olarak fatura edilir ve ödenir. Sonraki ayların lisans bedelleri her ayın ilk günü fatura edilir. Fatura ödeme vadesi en geç 14(On dört) gündür. Kullanıcı kaydı oluşturulduktan sonra İlgili ürün ve hizmetin ücretinin ödenmesinden imtina edilemez, ödenmiş olan ücret ve bedeller iade edilemez. İlk 6 aylık süreden sonra Müşteri her zaman 1 ay önceden paket iptal talebi göndererek lisansı sona erdirebilir. Aksi halde lisans her ay kendiliğinden yenilenerek kullanım devam eder. Starter Pack asgari 5 kullanıcı lisansının altına düşmemek kaydıyla kullanıcı lisansı sayısı Müşteri tarafından sonradan artırılabilir veya azaltılabilir. Starter Pack teklifinde belirtilen fiyata bulunduğunuz ülkede geçerli KDV ve varsa gümrük tarifelerinden kaynaklı olarak uygulanabilecek vergi, resim ve harçlar dâhil değildir.

4. Starter Pack Ürünü paylaşımlı bulut platformuna internet üzerinden çevrimiçi erişim sağlanması suretiyle kullanılır. Ürün’ün özellikleri www.next4biz.com/tr adresindeki web sitesinde anlatılmıştır. Ürün kullanımı amacıyla next4biz.com portalına erişim için bilgisayar ve internet erişimi gibi teknik gerekliliklerin kullanıcı tarafından karşılanması gerekir. Next4biz ürününün başka yazılım ve ürünler ile entegrasyonunun talep edilmesi halinde (örneğin: Çağrı Merkezi, ŞikayetVar, Whatsapp Business, Chat-ChatBot, Sosyal Medya, SMS/E-posta-SMTP gönderim servisleri ile entegrasyonlar) gerekli lisansların sağlanması müşterinin sorumluluğundadır.

5. Tüm destek hizmetleri uzaktan erişim ile verilmektedir. Destek hizmetlerinin kapsamı ve detayları www.next4biz.com/tr/destek-hizmetleri adresinde yer almaktadır.

6. Fikri Haklar: Next4biz yazılım ürünleri üzerindeki her türlü marka, patent, telif, faydalı model, tasarım, dizayn, görsel, şema üzerindeki haklar NEXT4BIZ’e aittir. Websitesi, ürün ve hizmetlere ilişkin görüntü ve dizaynlara ilişkin tüm telif hakları Next4biz adına tescillidir, tüm hakları saklıdır. HTML/CSS, Javascript, Ajax, Asp.Net veya diğer görseller ve dizayn unsurları kısmen veya tamamen Next4biz’in sarih yazılı izni olmadan kopyalanamaz, kullanılamaz. Starter Pack paketi ile size, ürün ve hizmetlere ilişkin bilgi formlarında belirtilen şekilde web sitesi ve ürün ve hizmetlerin kullanımı konusunda sınırlı bir yetki verilmiştir. Bu yetki hiçbir şekilde kısmen veya tamamen bir marka, patent hakkı, icat, telif, lisans, alan adı, ticari sır, bunlarla sınırlı olmaksızın hiçbir fikri ve sınai hakkın devri anlamına gelmemektedir.

Size yukarıdaki kapsamda verilen sınırlı kullanıcı lisansı hakkı, hiçbir şekilde başkalarına lisans, alt lisans, hak devri, satış, franchise verilmesi, yayma, işletme hakkı vs. gibi bir anlama gelmemektedir ve bu şekilde de yorumlanamaz.

Ürün kullanımı sırasında yasalara ve 6698 sy Kanuna aykırı kullanımların engellenmesi ve başkalarının haklarını ihlal edilmemesi için gereken tedbirleri kullanıcının kendisinin alması gerekmektedir.

Ürün ve hizmetler üzerinde değişiklik, düzeltme, mühendislik, ters mühendislik, yanlış bilgiler girilerek kullanıcı kaydı oluşturma, çalışmasını bozma ve buna teşebbüs eylemleri, virus yükleme vb. işlem ve eylemler kesinlikle yasaktır. Ürün ve hizmetlerin hukuka aykırı eylemler için kullanılması kesinlikle yasaktır. (örneğin: başkalarının şahsi haklarının ihlali, izinsiz e-mail gönderimi, çöp, bilgi, mesaj veya veri transferi amacıyla kullanım, toplu mesaj gönderimi, ürün veya hizmetlerin veya başkaca bir yazılımın unsurlarının ayrıştırılması, ters mühendislik, kaynak kodlarına erişim, zarar verici veya bozucu e-mail gönderimi, ırkçı, nefret söylemli, cinsel içerikli, mesaj veya hakaret ve sövme içeriklerin gönderimi)

7. Kullanım koşullarına uymamanız halinde Next4biz’in tek taraflı olarak ürün ve hizmetlerin sunumunu kısmen veya tamamen, kısa süreli olarak veya süresiz olarak askıya alma, sona erdirme hakkını saklı tutar.

8. Bilgi Güvenliği önlemlerimiz, sertifikasyon ve düzenli yapılan güvenlik testlerle ilgili bilgileri https://www.next4biz.com/tr/guvenlik-ve-uyumluluk sayfamızda bulabilirsiniz.

9. Next4biz ürünleri üzerinde penetrasyon, sızma, IDOR vb kategorilerde regülatif veya esnek güvenlik testleri, NIST, MITRE, OWASP vb çerçeve ve vektörlerde atak deneme ve gözden geçirmeleri, performans testleri yapılması, saldırı düzenlenmesi, zararlı istek gönderilmesi yasaktır.

10. Next4biz ürün ve hizmetlerini “mevcut haliyle” sunmaktadır, hiçbir şekilde kusursuzluk taahhüdü vermemektedir. Ürün özellikleri www.next4biz.com/tr sitesinde anlatılmaktadır. Next4biz’in doğrudan veya dolaylı her türlü zarar ve ziyan talebinden sorumluluğu en fazla son 6 ay içinde Müşteri’nin ödediği lisans bedeli ile sınırlıdır.

STARTER PACK TERMS OF USE
INTRODUCTION

STARTER PACK is a package of Next4biz CRM/CSM/BPM product. The rules you must abide by when purchasing this product package are determined in these terms of use.

Regarding the management and processing of the data you provide while using the product package, you can access our Privacy Policy, Commitment for GDPR, and Privacy Notice.

TERMS OF USE

1. Upon placing an order for the Starter Pack product package and making the payment for the package fee, you can start using the products and services included in the Starter Pack with your username and password.

2. The Starter Pack product package can only be used by the person(s) who have created the user registration and is limited to the number of licenses. Your username and/or password cannot be shared with third parties. For each registration opened on behalf of users of corporate customers, the individual username and passwords (“Login”) assigned must be used by those individuals themselves. Each company/customer is responsible for maintaining the records of the real persons using the accounts correctly and completely. A user account can only be used by the person for whom the user registration has been created. Each user is responsible for the confidentiality of their login information and must ensure that others do not log in with their credentials. The use of the products and services with tools other than real persons, such as robots, automated processors, artificial intelligence, requires additional licenses.

3. Starter Pack product license fee: The 6 (Six) monthly license fee specified in the product order and approval process, along with the service fee, is invoiced and paid in advance. The license fees for the following months are invoiced on the first day of each month. The payment period for invoices is a maximum of 14 (fourteen) days. Once the user registration is created, the payment for the relevant product and service cannot be refused, and the paid fees cannot be refunded. After the initial 6-month period, the Customer can always cancel the package by sending a cancellation request with 1-month prior notice. Otherwise, the license will automatically renew each month for continued use. Provided that the number of user licenses does not fall below the minimum of 5 licenses, the number of user licenses can be increased or decreased by the Customer later on. The price specified in the Starter Pack offer does not include any applicable taxes, customs duties, or tariffs due to the country you are in.

4. Starter Pack product is available to use by online access via internet to the next4biz shared cloud platform (www.next4biz.com). To use the Starter Pack product, the user is responsible for meeting technical requirements such as computer and internet access. If integration of next4biz product with other software and products is requested (e.g., Call Center, Complaints, Whatsapp Business, Chat-ChatBot, Social Media, SMS/Email-SMTP sending services), providing necessary licenses is the responsibility of the customer.

5. All support services are provided remotely. The scope and details of support services are available at www.next4biz.com/support-services/

6. Intellectual Property Rights: All rights on Next4biz software products, including trademarks, patents, copyrights, utility models, designs, visuals, schematics, belong to Next4biz. All copyrights related to the website, visuals, and designs regarding the products and services are registered in the name of Next4biz, and all rights are reserved. HTML/CSS, Javascript, Ajax, Asp.Net, or other visuals and design elements may not be copied or used, in whole or in part, without the express written permission of Next4biz. With the Starter Pack package, you are granted limited authorization to use the website and products and services as indicated in the information forms related to the website and products and services. This authorization does not, in any way, mean the transfer of any intellectual property rights, such as a trademark, patent right, invention, copyright, license, domain name, trade secret, or any other intellectual and industrial property rights, either partially or entirely.

The limited user license right given to you within the scope above does not imply and cannot be interpreted in any way as granting others a license, sublicensing, assignment of rights, sale, franchise, distribution, or operating rights.

During product usage, the user must take necessary precautions to prevent illegal uses and infringement of the rights of others.

Any actions that include changes, corrections, engineering, reverse engineering, creating user registrations with false information, disrupting the operation, and any attempt actions, loading viruses, etc., on the product and services, are strictly prohibited. Using the product and services for illegal actions is strictly prohibited (e.g., violation of personal rights of others, unauthorized email sending, use for bulk message sending, disassembly of product or service elements, reverse engineering, access to source codes, sending harmful or disruptive emails, using it for racist, hate speech, sexually explicit, message, or sending offensive content).

7. If you do not comply with the terms of use, Next4biz reserves the right to suspend or terminate, either partially or completely, the provision of products and services, temporarily or permanently, unilaterally.

9. Regulatory or flexible security tests such as penetration, infiltration, IDOR, NIST, MITRE, OWASP, etc., attack tests and reviews, performance tests, and actions such as attacking, sending malicious requests, on Next4biz products are prohibited.

10. Next4biz provides its products and services “as is” and does not make any commitment to flawlessness. The product features are explained on the www.next4biz.com website. Next4biz’s liability for any and all claims for damages is limited to the license fee paid by the Customer in the last 6 months at most.
